Hogfish Bay Giveaway Terms and Conditions

1. Eligibility:

• The Hogfish Bay Giveaway (the “Giveaway”) is open to residents of United States of America who are 18 years of age or older at the time of entry.
• Employees, officers, and directors of Hogfish Bay, its affiliates, subsidiaries, advertising, and promotion agencies, and immediate family members and/or those living in the same household are not eligible to participate in the Giveaway.

2. Sponsor:

• The Giveaway is sponsored by Hogfish Bay, located at 404 NW 19th St, Gainesville, FL 32603.

3. Agreement to Rules:

• By participating, the contestant (“You”) agree to be fully unconditionally bound by these rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Hogfish Bay as final and binding as it relates to the content of this Giveaway.

4. Giveaway Period:

• Entries will be accepted starting on 06/26/2024 6 PM EST and ending two weeks later on 07/6/2024 9PM EST. All entries must be received by 06/25/2024 at 9 PM EST.

5. How to Enter:

• The Giveaway must be entered by performing any of the following actions on Hogfish Bay’s social media platforms:
• The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Hogfish Bay.

6. Prizes:

• The winner(s) of the Giveaway (the “Winner”) will receive:
• Actual/appraised value may differ at the time of prize award. The specifics of the prize shall be solely determined by Hogfish Bay. No cash or other prize substitution shall be permitted except at Hogfish Bay's discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the Winner is permitted.

7. Winner Selection and Notification:

• Winner will be selected by a random drawing using a random generator under the supervision of Hogfish Bay. Winner will be notified by email/phone/social media within 5 days following selection of Winner. Hogfish Bay shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.

8. Rights Granted by You:

• By entering this Giveaway, You understand and agree that Hogfish Bay, anyone acting on behalf of Hogfish Bay, and Hogfish Bay’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, photo, portrait, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms & Conditions:

• Hogfish Bay reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway should a virus, bug, non-authorized human intervention, fraud, or other cause beyond Hogfish Bay’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Hogfish Bay may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Hogfish Bay. Hogfish Bay reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.

10. Limitation of Liability:

• By entering, You agree to release and hold harmless Hogfish Bay and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof.

11. Disputes:

• THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND FL , WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in FL having jurisdiction.

13. Winners List:

• To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Hogfish Bay, 404 NW 19th St, Gainesville, FL 32603. Requests must be received no later than 07/21/2024.
